Terms of Service

1. Agreement to Terms
These Terms of Service (“Terms”) are a binding legal agreement between you and Supper (“Supper”, “we”, “us”, or “our”), the AI-powered nutrition and meal planning service available at heysupper.com and as a Progressive Web App (“Service”).
By creating an account, ticking the consent checkboxes at sign-up, or otherwise using any part of the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use Supper.
If any applicable mandatory law in your jurisdiction grants you rights that conflict with these Terms, those mandatory rights prevail to the extent of the conflict.
2. Medical Disclaimer
Supper is a wellness tool — not a medical service.
All content provided through the Service — including AI-generated meal plans, nutritional estimates, ingredient suggestions, and weekly progress summaries — is for general informational and wellness purposes only. It does not constitute and must not be relied upon as medical advice, diagnosis, treatment, or a substitute for guidance from a qualified healthcare professional.
Always consult a qualified healthcare professional — such as a registered dietitian, physician, or specialist — before making significant dietary changes, particularly if you have or suspect any medical condition, take prescription medications, are pregnant or breastfeeding, or are under 18 years of age.
Supper is not a licensed healthcare provider, registered dietitian, nutritionist, or medical professional. Use of the Service does not create any professional relationship between you and Supper. We are not regulated as a healthcare service under any jurisdiction.
3. Eligibility
You must be at least 13 years old to use Supper. If you are between 13 and 18 (or the relevant age of majority or digital consent in your jurisdiction, whichever is higher), a parent or legal guardian must review and agree to these Terms on your behalf, and they accept responsibility for your use of the Service.
In jurisdictions where the age of digital consent is higher than 13 (for example, 16 in certain EU member states), users below that threshold must have verifiable parental consent before using the Service.
By using Supper, you represent and warrant that: (a) you meet the minimum age requirement; (b) you have legal capacity to enter into a binding agreement; and (c) your use of Supper complies with all laws applicable to you.
4. Account Registration and Security
To use Supper, you must create an account via our authentication provider (Clerk). You agree to provide accurate, current, and complete information and keep it updated. You are responsible for:

- —All activity that occurs under your account.
- —Notifying us immediately at hello@heysupper.com if you suspect unauthorised access.
You may not create more than one account per person without our written consent. Accounts are personal and non-transferable.
5. The Service
Supper provides an AI-powered personal nutrition experience, including:
- —Personalised 7-day meal plans generated from your health profile.
- —Meal-by-meal tracking and daily progress monitoring.
- —Meal swap and ingredient substitution suggestions.
- —Calorie and macronutrient estimates (for informational purposes only — see Section 6).
- —Weekly recap and progress summaries.
- —Push notification reminders for meals and streaks.
We reserve the right to modify, suspend, or discontinue any feature of the Service at any time. Where practicable, we will give reasonable advance notice of material changes.
6. AI-Generated Content
Supper uses large language models (currently Claude, provided by Anthropic PBC) to generate meal plans, meal suggestions, ingredient substitutions, macronutrient estimates, and weekly recap insights. You acknowledge that:
- —AI outputs are probabilistic and may contain errors, inaccuracies, or omissions.
- —Calorie and macronutrient values are estimates, not precise measurements. Actual values vary by preparation method, ingredient brand, and portion size.
- —AI-generated meal plans may not account for all nutritional interactions, particularly where you have specific medical conditions.
- —You should exercise your own judgement and seek professional advice before acting on any AI-generated recommendation that affects your health.
- —Supper does not use your personal health data to train AI models.
7. Acceptable Use
You agree not to:
- —Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- —Attempt to circumvent rate limits, security controls, or access controls.
- —Scrape, copy, or systematically extract content from the Service without our written consent.
- —Use automated tools (bots, scripts, crawlers) to access the Service.
- —Impersonate any person or organisation, or provide materially false identity information.
- —Submit false, misleading, or harmful health information with intent to generate harmful outputs.
- —Reverse engineer, decompile, or attempt to extract the source code of the Service.
- —Resell, sublicense, or commercially exploit the Service without our written consent.
- —Introduce malicious code, viruses, or any material that could harm our systems or other users.
We reserve the right to suspend or terminate accounts that violate these rules, with or without prior notice.
8. Your Content and Data
You retain ownership of the personal data and content you submit to Supper — including your health profile, food logs, weight logs, check-ins, and similar inputs (“Your Content”). By using the Service, you grant us a limited, non-exclusive, worldwide licence to process Your Content solely for the purpose of providing the Service to you.
We do not sell your personal data to third parties. We do not use your personal health data for advertising purposes. See our Privacy Policy for full details of how we handle your data.
You are responsible for ensuring that any content you submit does not violate applicable law or the rights of any third party.
9. Intellectual Property
The Supper application, brand, design, software, and all content we create (excluding Your Content) are owned by us or our licensors and are protected by intellectual property laws worldwide. You may not copy, modify, distribute, or create derivative works from our intellectual property without our prior written permission.
Meal plans generated for you are licensed to you for personal, non-commercial use only. You may save or print them for personal reference.
10. Pricing and Subscriptions
Supper is currently offered free of charge. If we introduce paid features or subscriptions, we will provide at least 30 days’ advance notice and will not charge you without your explicit, affirmative consent. Any future pricing terms will be published on our website and incorporated into these Terms.
11. Termination and Account Deletion
You may delete your account at any time via Settings › Delete my account (at the bottom of the Settings page). Account deletion immediately and permanently removes all your personal data from our systems via a cascade delete, subject to the limited retention exceptions described in our Privacy Policy.
After account deletion, a 14-day re-registration cooldown applies to the email address associated with your deleted account. This is a security measure to prevent abuse.
We may suspend or terminate your account if we reasonably determine that you have violated these Terms, engaged in fraudulent activity, or pose a risk to the Service or other users. Where permitted by applicable law, we will provide notice of termination. Upon termination, your right to use the Service ceases immediately.
12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION.
We do not warrant that the Service will meet your requirements, produce any particular health or dietary outcome, or that defects will be corrected. We are not responsible for any dietary or health outcomes arising from your use of the Service, or for interruptions caused by third-party services.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SUPPER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR ANY HEALTH OUTCOMES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING YOUR CLAIM; OR (B) USD 50 (OR EQUIVALENT IN YOUR LOCAL CURRENCY).
Some jurisdictions do not permit the exclusion or limitation of certain warranties or liability, so the above may not fully apply to you. In such jurisdictions, our liability is limited to the greatest extent permitted by law. Nothing in these Terms limits liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any other liability that cannot be excluded or limited by law.
14. Indemnification
You agree to indemnify, defend, and hold harmless Supper and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) any content you submit to the Service that infringes a third-party right.
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles, except where mandatory consumer protection laws of your country of residence provide greater protection — in which case those mandatory protections apply.
Informal resolution first. If you have a dispute with us, please contact us at hello@heysupper.com first. We will make a genuine effort to resolve any issue informally within 30 days.
EU / EEA / UK users: Nothing in these Terms affects your rights as a consumer under the mandatory laws of your country of residence, including the right to bring proceedings before your local courts or consumer protection bodies. EU and UK consumers retain all statutory rights available to them regardless of the governing law clause above.
India users: Disputes may be referred to consumer forums established under the Consumer Protection Act, 2019, in addition to any other available legal remedies.
16. Third-Party Services
The Service integrates with third-party providers including:
- —Clerk — authentication and identity management
- —Supabase — database hosting
- —Anthropic — AI model for plan generation, meal suggestions, and onboarding intake
- —PostHog — anonymised product analytics
- —Sentry — error tracking
- —Vercel — hosting and CDN
- —Resend — transactional email delivery
Your use of the Service is also subject to the terms and privacy policies of these third-party providers. We are not responsible for the practices of any third-party service provider.
17. General Provisions
Entire Agreement
These Terms and our Privacy Policy constitute the entire agreement between you and Supper regarding the Service and supersede all prior agreements, representations, and understandings relating to the same subject matter.
Severability
If any provision of these Terms is held invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will continue in full force and effect.
No Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of Supper.
Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets, provided that we provide you with reasonable notice.
Force Majeure
We will not be liable for any delay or failure to perform our obligations to the extent caused by circumstances beyond our reasonable control, including acts of God, natural disasters, pandemic, war, governmental action, power failures, or failures of third-party infrastructure such as internet service providers or cloud platforms.
Relationship of the Parties
These Terms do not create any partnership, joint venture, employment, franchise, or agency relationship between you and Supper.
18. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email and by displaying a prominent notice within the app at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
